This Biodynamic Gardening Calendar iOS app End User License Agreement is between you and Floris Books Trust Ltd. and governs your use of Floris Books’ mobile applications for iOS.

Parties

This agreement is between you and Floris Books Trust Ltd. only, and not Apple Inc. Floris Books Trust Ltd. is solely responsible for the Biodynamic Gardening Calendar iOS app and its content. Although Apple is not a party to this agreement, Apple has the right to enforce this agreement against you as a third-party beneficiary relating to your use of the Biodynamic Gardening Calendar iOS app.

Limited License

Floris Books Trust Ltd. grants you a limited, non-exclusive, non-transferrable, revocable license to use the Biodynamic Gardening Calendar iOS app for your personal, non-commercial purposes. You may use the Biodynamic Gardening Calendar app on any Apple device that you own or control and as permitted by the Apple App Store Terms of Service.

In-App Purchases

If you purchase an auto-renewing subscription through the Biodynamic Gardening Calendar iOS app, your iTunes account will be billed continuously for the subscription until you terminate it as set forth below. After your initial subscription period, and again after any subsequent subscription period, your subscription will automatically renew for an additional equivalent period. If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your iTunes account and terminate or change your subscription.

You agree to pay all fees and applicable taxes incurred by you or anyone using the iTunes account registered to you which is used to purchase an auto-renewing subscription. Floris Books Trust Ltd. may revise the pricing auto-renewing subscription at any time. All information that you provide in connection with a purchase or transaction must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases and transactions.

Maintenance and Support

To the extent that any maintenance or support is required by applicable law, Floris Books Trust Ltd., not Apple, shall be obligated to furnish any maintenance and support services with respect to the Biodynamic Gardening Calendar iOS app.

Warranty

The Biodynamic Gardening Calendar iOS app is provided on an ‘as is’ basis. As such, Floris Books Ltd. disclaims all warranties about the app to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Floris Books Trust Ltd., not Apple, shall be solely responsible for such warranty.

Product Claims

Floris Books Trust Ltd. does not make any warranties concerning the Biodynamic Gardening Calendar iOS app. To the extent you have any claim arising from or relating to your use of the Biodynamic Gardening Calendar app, Floris Books Trust Ltd, not Apple, is responsible for addressing any such claims, which may include, but are not limited to: (i) any product liability claim; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this agreement shall be deemed an admission that you may have such claims.

Intellectual Property Rights

Floris Books Trust Ltd. shall not be obligated to indemnify or defend with respect to any third-party claim arising out or relating to the Biodynamic Gardening Calendar iOS app. To the extent Floris Books Trust Ltd. is required to provide indemnification by applicable law, Floris Books Trust Ltd., not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any claim that the app or your use of it infringes any third-party intellectual property right.

Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ‘terrorist supporting’ country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Biodynamic Gardening Calendar app. Your right to use this app will terminate immediately if you violate any provision of this agreement.

Third-Party Beneficiary

Apple is a third-party beneficiary of this agreement and, upon your acceptance, such third-party beneficiary will have the right (and will be deemed to have accepted the right) to enforce this agreement against you.
